Welcome to The Asian Roundtable of Colorado / Action Against Hate ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our app and services, including the anonymous hate incident reporting tool and public map display powered by Google Maps Platform.

By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Purpose of the Service
Action Against Hate is a platform that allows users to report hate incidents anonymously or optionally identify themselves or their organization. All submissions are displayed publicly on a map to increase awareness and support transparency around hate incidents.

2. Eligibility
You must be at least 16 years old to use this app. If you are under 18, you may use the app only with the consent and supervision of a parent or guardian.

3. User Responsibilities
When submitting a report, you agree to the following:
Reports must be made in good faith and should reflect a real incident to the best of your knowledge.

You are solely responsible for the accuracy of the information you provide.

Do not include names, contact information, or other personally identifying information about individuals involved in the incident (except your own name or organization, if you choose to disclose it).

You may optionally include your name or organization, and you understand that this information will be publicly visible and cannot be removed or edited after submission.

4. Privacy and Use of Reports

Reports submitted through the Action Against Hate platform are not publicly displayed. Information submitted through a report is maintained for program purposes, including documenting and better understanding hate and bias incidents, identifying trends, conducting research and program evaluation, and improving community education and resources.

Action Against Hate may use aggregated or de-identified information from reports in reports, presentations, educational materials, research, or other program activities. Information that directly identifies an individual will not be publicly disclosed through these activities unless permission has been provided or disclosure is otherwise required by law.

Submitting a report to Action Against Hate does not constitute filing a report with law enforcement, a government agency, or a legal authority. Action Against Hate does not investigate reports, provide legal representation, or act as an advocate on behalf of individuals who submit reports.

Reports may be retained as reasonably necessary for the purposes described above and in accordance with applicable organizational policies and legal requirements.

5. Prohibited Conduct
You agree not to:
Submit false or misleading reports

Impersonate any individual or organization

Post content that is defamatory, harassing, discriminatory, or violates any applicable laws

Attempt to scrape, hack, or interfere with the platform or data

Use the service for commercial purposes or spam

We reserve the right to remove any content and/or suspend access if you violate these Terms or misuse the service.

6. Use of Google Maps Platform
Our service uses the Google Maps Platform to display report data. Your use of this functionality is subject to:

We do not use location services to track users, and location data is only used for the purpose of displaying incidents on the map.

7. Data Retention and Modification
Submitted reports, including optional names or organizational identifiers, are publicly visible and are stored indefinitely. We do not offer options to delete or edit submissions once posted, to maintain data integrity.

8. Disclaimer and Scope of Services

Action Against Hate is a community education and incident-reporting program. Action Against Hate is not a law firm, legal services provider, advocacy organization, victim services agency, law enforcement agency, or investigative body. We do not provide legal advice or representation, individual advocacy, case management, emergency services, or investigations.

Information and resources provided through the website and mobile application are for general educational and informational purposes only and do not constitute legal advice. Links or referrals to external organizations are provided for informational purposes and do not mean that Action Against Hate provides, endorses, or guarantees the services of those organizations.

Submitting an incident report to Action Against Hate does not create an attorney-client, advocate-client, or other professional service relationship and does not constitute filing a report or complaint with law enforcement, a court, or any local, state, or federal government agency. Individuals are responsible for contacting the appropriate agency or qualified professional regarding filing requirements, deadlines, legal rights, or emergencies.

9. Limitation of Liability
To the fullest extent permitted by law, Action Against Hate is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the app or reliance on any content provided through the platform.

10. Changes to These Terms
We may update these Terms at any time. When we do, the "Last Updated" date will be revised. Continued use of the platform after changes means you accept the revised Terms.
